Alleged General Motors’ Multi-billion dollar

Warranty fraud, corruption, and the undermining

of the Canadian economy, its people, and its

Government.

I allege that Defendant General Motors of Canada is using unfair

and ‘impossible to comply with’ Warranty and Owner’s Manual’s

policies to cheat and defraud its customers, including myself,

across North America. GM is literally stealing from customers,

undermining the economy and the Authority of Government. It is

abusing our laws, the good faith of its customers, and the

People of Canada.

I allege that General Motors is knowingly driving people into

financial ruin and poverty and the firm is destroying families and

wrecking people’s lives, in order to retain ill-gotten gains by

criminally dismissing Warranties that should have been

honoured. Unconscionable Warranty Terms, and Owner’s

Manual directions such as ‘Perform an oil level check at each

fuel fill or else your Warranty is invalid’ is idiotic, abusive and

completely out of touch with reality. More importanly it’s

impossible to verify and it’s unenforceable. That clause or

direction, amongst others, is being used to dismiss Warranty

claims across the board. The grossly unfair clauses and terms

and conditions are intentionally designed and implemented by

Defendant General Motors of Canada to invalidate every

Warranty ever provided. I allege that every Warranty on every

car is invalid before the car ever leaves the showroom.

I had a Special Coverage Warranty for excessive oil

consumption on my 2013 GMC Terrain that had a badly

designed engine as proven by a class action in the US that led

to the creation of the Warranty.

I allege that Defendant General Motors of Canada conspired

with its dealership network, (in particular second Defendant in

the case Dueck Richmond; a part of Dueck Auto Group), to do

everything they could to find a way to dismiss my Warranty

Claim when they knew it should have been upheld.

This included:

Deceitfully making me test my vehicle 25 times for oil

consumption when only 2 times was required, because I

wouldn’t buy a new car from them.

Making up repairs and providing estimates for work that didn’t

need doing, that would cost thousands of dollars.

Falsifying Certified Vehicle Inspection check sheets and then

later submitting legal defences that claimed I didn’t maintain my

vehicle because I hadn’t paid them to do the work that didn’t

need doing.

On another occasion they had deliberately overfilled the oil so

that plumes of oil smoke came out of the exhaust, in order to try

to conceal true oil levels.

On another visit they had advised me that I had to have a hot

engine flush to try to ‘resolve the problem’ when the Owner’s

Manual advises that hot oil flushes cause serious engine

damage.

My car had consumed around 90 litres of oil in only 70,000kms.

This is corporate crime and fraud. I made a fraud report and

during GM’s own internal investigation, Defendant Dueck was

fraudulently misrepresenting test results to GM, falsifying and

erasing evidence in the GM Dealer Management System to

conceal data, and actually forging Service Invoices that didn’t

exist, to try and make legal defences make sense. GM knew the

information was false (and has subsequently submitted that

evidence to Court and has relied upon it in Defence) and refused

to replace my engine and compensate me because it would cost

GM around $30,000. They offered to replace pistons and rings

but refused any compensation for my loss of income of around

$10k and by that time the engine was ruined. The engine

eventually failed in 2023 and I was left screwed with losses now

amounting to almost $100k. General Motors are trying to force

their losses for their badly designed junk cars onto the customer

as the only way of remaining in business. I sued out a claim in

Vancouver Supreme Court: S218173.

During proceedings and after GM had confessed in August 2021

that they knew the oil consumption was excessive, there have

been some very sinister events taking place that would see the

average man on the street go to jail. I allege the Defendants and

their law firms were conspiring to make their legal defences tally

up and have authored and submitted legal defences that are

fraudulently misrepresented and which they knew were false at

the time they wrote them. This is proven by their own later

submitted documents. Read through this site to see it all in black

and white in undeniable evidence. To date I’ve won

approximately 13 Court Orders that both Defendants refuse to

comply with. This is the shocker: Defendant General Motors has

actually physically destroyed evidence after a Court Order was

made to disclose it because they knew it would further prove my

allegations and both Defendants have intentionally concealed

other critical evidence that proves my claim.

When I win this case, it should open the floodgates for everyone

to sue General Motors for Breach of Warranty due to grossly

unfair and unenforceable Warranty terms and Owner’s Manual

instructions. In theory, everyone would get the same payout as

me depending on their circumstances. If you have had your

Warranty dismissed and you think you’ve been shafted by

General Motors, then you will have a route of recourse. I’ll be

book on how to defeat General Motors with an easy winning
